SECTRON EMA Application — Terms of Service and Data Protection Policy

These terms describe the rules for using the SECTRON EMA application and the way in which SECTRON s.r.o. processes the personal data of application users. This document is intended for display within the application under "Terms of Service and Data Protection Policy".

1. Who Provides the Service

The operator of the SECTRON EMA application is SECTRON s.r.o., Company ID (IČO): 64617939, VAT ID (DIČ): CZ64617939, registered office at Josefa Šavla 1271/12, Mariánské Hory, 709 00 Ostrava, Czech Republic, registered in the Commercial Register maintained by the Regional Court in Ostrava, Section C, Insert 14152.

In these terms, we use the designations "SECTRON", "we" or "operator". The application user is referred to as "user" or "you".

2. What is SECTRON EMA — ElectroMobility Administrator

SECTRON EMA is a digital customer application designed primarily for managing services, devices, customer accounts, and communication with SECTRON. The specific features of the application may vary depending on which SECTRON products or services you use and what permissions are configured for your account.

SECTRON EMA may enable, in particular:

  • viewing your customer profile, contractual or service data,
  • managing devices, metering, telemetry, charging or other technical points,
  • viewing operational, status, service or consumption data,
  • submitting requests, reporting faults, complaints or service events,
  • communicating with customer support,
  • viewing documents, notifications, billing or payment information,
  • ordering or activating selected services, where this option is made available in the application.

If a particular feature is available only for a specific service, device, customer role or account type, this does not create an obligation on SECTRON to make it available to all users.

3. Relationship to Other Agreements

These terms govern the use of the SECTRON EMA application. If you have a separate contract, order, service agreement, equipment supply agreement, licence or other commercial arrangement with SECTRON, the products and services themselves are also governed by those separate documents.

In the event of a conflict, the individual contract, order or special conditions of the specific service shall take precedence. These terms do not replace technical documentation, safety instructions or device manuals.

If the application enables the purchase of goods or the ordering of a service from the SECTRON e-shop, the relevant e-shop terms and conditions or special conditions displayed prior to order submission may also apply to such a purchase.

4. User Account

Some features of SECTRON EMA are available only after logging in. An account may be created by registration, by invitation from SECTRON, by assignment to an existing customer, or by another procedure permitted by the application.

When creating and using an account, you are required to provide accurate, complete and up-to-date information. If you are acting on behalf of a legal entity, sole trader, municipality, institution or other customer, you confirm that you are authorised to do so.

Protect your access credentials from misuse. If you discover or suspect that an unauthorised person has gained access to your account, notify us without undue delay. You are responsible for activity carried out through your account to the extent caused by you or by a person to whom you have granted access.

SECTRON may temporarily restrict or block access to an account where necessary for security reasons, for data protection purposes, where account misuse is suspected, or where these terms have been breached.

5. Rules for Using the Application

Use the application only in the manner for which it is intended. You must not use it, in particular, to:

  • gain unauthorised access to accounts, systems, devices or data,
  • disrupt the operation of the application, network, servers or connected devices,
  • circumvent security features, limits or permissions,
  • carry out automated data scraping without our prior consent,
  • distribute malicious code, spam, fraudulent messages or unlawful content,
  • interfere with the application, its source code, interfaces or protective elements,
  • act in a manner that could harm SECTRON, other users, customers or third parties.

If you upload text, photographs, documents or other materials to the application, you are responsible for ensuring that you have the right to use them and to provide them to SECTRON. Do not upload data that is not necessary for handling your request.

6. Orders, Paid Features and Payments

If the application enables you to order goods, a service, a subscription, a service call, a licence or another paid feature, you will be shown the key information before submitting the order, including in particular a description of the deliverable, the price, any applicable taxes, payment terms, the duration of the service and the method of termination.

An order is bindingly placed only upon confirmation via a button or other element that clearly indicates that the action constitutes an order associated with a payment obligation. We will confirm receipt of your order electronically. Automatic confirmation of receipt of a request does not necessarily constitute conclusion of a contract, where the specific service states that the order requires subsequent approval by SECTRON.

Payments may be processed by SECTRON or by an external payment service provider. The payment method provider may process certain data as an independent controller under its own rules.

Where a paid service is provided on a recurring basis, we will display the price, billing period and termination conditions to you in advance. If the price or conditions of a recurring service change materially, we will notify you in advance.

7. Consumer Rights in Distance Contracts

If you are a consumer — that is, a natural person who, when using the application or placing an order, is not acting in the course of a business or independent professional activity — you are entitled to rights under consumer protection legislation.

In the case of a distance contract, you may generally withdraw within 14 days of conclusion of the contract or of receipt of the goods, unless an exception is provided for by law.

For a digital service, digital content or a service provided before the expiry of the 14-day period, you may be asked for your express consent to the commencement of performance before it begins. If performance is commenced at your request, your right of withdrawal may be limited to the extent permitted by law. Where a service has been partially provided, you may be required to pay a proportionate part of the price for performance already delivered.

You may send your withdrawal to obchod@sectron.cz or in writing to SECTRON's registered office address. A model withdrawal notice is set out at the end of these terms.

8. Complaints, Defects in the Digital Service and Support

If the application is not functioning correctly, contact us via the in-app support or at hotline@sectron.cz. In your report, please include a description of the issue, your device type, the application version, the time of occurrence, and a screenshot if one is needed to resolve the matter.

A user who is a consumer is entitled, in the event of defects in the digital service, to the rights set out in the Civil Code. Depending on the nature of the defect, the user may request in particular a remedy, a proportionate price reduction or termination of the contract, where permitted by law.

We handle complaints and grievances without undue delay, and no later than within the time limits set by law. To assess a technical fault, we may require your cooperation, such as updating the application, verifying your connection or providing additional information about your device.

9. Availability, Maintenance and Changes to the Application

SECTRON strives to operate EMA reliably and securely. However, the application may not be available continuously. Availability may be limited in particular during maintenance, updates, internet outages, third-party service outages, security measures or events beyond our control.

EMA may be updated on an ongoing basis. Updates may introduce new features, modifications to existing features, security patches or compatibility changes. Some features may require an up-to-date version of the application or operating system, an internet connection, a supported device or an active customer service.

Data displayed in the application — in particular operational, technical, measured or consumption data — may be informational in nature, unless expressly stated otherwise for a specific service. The authoritative data may be that set out in the contract, invoice, service report, metering system or other binding documentation.

The EMA application is not an emergency, breakdown or safety service. In urgent situations, use the appropriate emergency, breakdown or service contacts.

10. Intellectual Property

The EMA application, its appearance, source code, databases, texts, graphics, designations and other elements are protected by the intellectual property rights of SECTRON or its suppliers.

For the duration of your authorised access to the application, SECTRON grants you a non-exclusive, non-transferable and revocable permission to use the application for your own purposes and in accordance with these terms. This permission does not include the right to copy, modify, rent, sell, transfer, reverse engineer or make the application available to third parties beyond the normal use permitted by the application.

11. Liability

SECTRON is liable for damage and harm to the extent provided for by law. This does not affect consumer rights that cannot be contractually limited.

To the extent permitted by law, SECTRON is not liable for difficulties caused in particular by:

  • improper use of the application,
  • an outdated version of the application or operating system,
  • an internet outage, mobile network failure, user device failure or third-party service failure,
  • data entered by the user or by a person acting through their account,
  • unauthorised interference with a device, account or access credentials,
  • a decision made by the user based solely on informational data not intended as a binding basis for action.

The user acknowledges that a digital service cannot fully replace a professional device inspection, a service call, a binding measurement or safety procedures required by law or technical documentation.

12. Termination of Use

You may stop using the application at any time. If you wish to close your account, contact support or use the relevant feature in the application, if available.

Closing your account does not automatically affect the continuation of separate contracts, orders, invoices, service obligations or statutory duties. We may therefore retain certain data even after account closure, where this is necessary for the performance of a contract, a legal obligation or the protection of legal claims.

SECTRON may close or restrict an account if the user materially breaches these terms, misuses the application, endangers security, has not used the account for an extended period, or where the legal basis for access to the service ceases to exist.

13. Changes to the Terms

We may amend these terms on a reasonable basis, in particular due to changes in legislation, changes to the application, the introduction of new features, security requirements, changes to the business model, or changes to technical and operational processes.

We will notify you of any material change in an appropriate manner, for example within the application or by email. If you do not agree with the change, you may stop using the application before the change takes effect. This does not affect your statutory rights or any claims that have already arisen.

14. Governing Law and Dispute Resolution

These terms are governed by the laws of the Czech Republic. If you are a consumer and the laws of your country of residence afford you greater protection, that protection is not affected.

We will endeavour to resolve any disputes preferably by amicable means. You may contact us at obchod@sectron.cz or in writing at SECTRON's registered office address.

A consumer has the right to submit a proposal for out-of-court resolution of a consumer dispute to the relevant ADR body. In ordinary consumer disputes not falling within the jurisdiction of a specialised authority, the competent body is the Czech Trade Inspection Authority, Štěpánská 567/15, 120 00 Prague 2, website: https://adr.coi.cz/cs. Depending on the nature of the specific service, another ADR body may also be competent, such as the Czech Telecommunication Office, the Energy Regulatory Office or the Financial Arbitrator.

The European Online Dispute Resolution (ODR) platform was discontinued in 2025 and is therefore not referenced in these terms.

Data Protection Policy for the EMA Application

15. Data Controller

16. What Personal Data We Process

In connection with the EMA application, we may process the following categories of data:

  • identification data, such as first name, surname, company name, Company ID, VAT ID, customer number, user role or authorisation to act on behalf of a customer,
  • contact data, such as email address, phone number, address, billing address or delivery address,
  • account data, such as login identifier, account settings, language, role, permissions, login history and security logs,
  • contractual and customer data, such as information about services used, orders, contracts, complaints, service requests and communications,
  • payment and billing data, such as information required for issuing documents, reconciling payments or resolving payment queries,
  • technical and operational data, such as device identification, SIM, module, router, metering point, charging point, service status, operational events, telemetry or measured data, where these form part of the service provided,
  • application usage data, such as login time, features used, error messages, device type, operating system, application version, IP address, cookie identifiers or similar technologies,
  • communication data, such as the content of queries, requests, emails, in-app messages, telephone or service records,
  • user-submitted data, such as photographs, documents, fault descriptions, notes or files required to handle a request,
  • preferences and consents, such as notification settings, marketing preferences or choices relating to cookies and analytics.

We do not deliberately require special categories of personal data — such as health data or biometric data for the purpose of unique identification — in the EMA application. If you nonetheless provide us with such data, we will process it only to the extent necessary to handle your request, or we will delete it if there is no basis for processing it.

17. Why We Process Data and on What Legal Basis

Performance of a contract and provision of the application

We process data in order to create and manage your account, provide access to application features, display data relating to services and devices, handle requests, provide support, process orders and fulfil contractual obligations.

The legal basis is the performance of a contract or the taking of steps prior to entering into a contract.

Compliance with legal obligations

We must process certain data to comply with statutory obligations, in particular in the areas of accounting, taxation, consumer complaints, contract records, cybersecurity or cooperation with public authorities.

The legal basis is compliance with a legal obligation.

Legitimate interests of SECTRON

We may also process data on the basis of our legitimate interests. These include in particular:

  • protecting the application, accounts, devices, network and data from misuse,
  • preventing fraud, unauthorised access and security incidents,
  • evidencing legal acts and asserting and defending legal claims,
  • internal record-keeping, auditing, reporting and quality management,
  • improving the application, services, user experience and customer support,
  • sending commercial communications relating to our own similar products and services to customers, where permitted by law and where you have not opted out of such communications.

You may object to processing based on legitimate interests. In the case of direct marketing, we will cease processing your data for that purpose.

Consent

In some cases, we process data on the basis of your consent. This may typically include:

  • marketing communications, where they cannot be sent on the basis of legitimate interests,
  • optional analytical, advertising or similar technologies,
  • access to the location, camera, files or contacts of your device, where the application requires this for a specific feature and you grant permission,
  • marketing push notifications.

You may withdraw your consent at any time. Withdrawal of consent does not affect the lawfulness of processing carried out prior to withdrawal.

18. Data Retention Periods

We retain personal data only for as long as necessary for the given purpose.

The following general retention periods apply:

  • account data and data required for the provision of the application are retained for the duration of the account or contractual relationship,
  • data relating to orders, contracts, payments and invoices are retained for the period required by law, generally 5 to 10 years depending on the type of document,
  • data relating to complaints, service requests and customer communications are retained for the duration of the handling of the request and subsequently for the period necessary to protect legal claims,
  • security and technical logs are retained for the period necessary to protect the service, generally no longer than 12 months, unless a specific incident requires longer retention,
  • analytical data are retained in aggregated or pseudonymised form for the period necessary for service evaluation and improvement,
  • data processed for marketing purposes are retained until consent is withdrawn, marketing is declined, or the data are no longer needed,
  • data required for legal claims are retained for the duration of the applicable limitation periods, generally 3 years, and in justified cases longer depending on the nature of the claim; where proceedings are ongoing, data are retained for their duration.

Upon expiry of the applicable period, we will delete, anonymise or restrict the processing of data, unless further retention is required by law.

19. Recipients of Data

Personal data may be disclosed only to the extent necessary for the purposes stated above. Recipients may include in particular:

  • providers of IT infrastructure, hosting, cloud services, databases, backup and security tools,
  • developers, administrators and service partners of the EMA application,
  • providers of customer support, email, SMS, push and communication services,
  • providers of analytical and diagnostic tools,
  • payment institutions, banks or payment gateway providers, where the application enables payments,
  • accounting, tax, legal and audit advisors,
  • service, installation, logistics or technical partners, where necessary for the handling of a service, device, complaint or service request,
  • SECTRON's business partners, where they are involved in the provision of a specific service and this is necessary for that service,
  • public authorities, courts, administrative bodies or law enforcement authorities, where we are required to do so by law or where it is necessary to protect rights.

We enter into data processing agreements with processors and bind them to data protection obligations. We do not sell personal data.

20. Transfers Outside the European Economic Area

We process personal data preferentially within the European Union or the European Economic Area. If a transfer outside this area is to take place, we will ensure an appropriate legal mechanism is in place, such as an adequacy decision by the European Commission, standard contractual clauses or another instrument under the GDPR.

21. Cookies, Analytics and Similar Technologies

The application and related web interface may use cookies, device identifiers, SDKs, local storage or similar technologies.

We use technical technologies for login, security, remembering preferences, form functionality and the basic operation of the application. These technologies are necessary for the provision of the service.

We use analytical or marketing technologies only where we have a legal basis to do so, in particular your consent, or where processing is permitted by law. You may change your settings within the application, via the cookie banner, in your device settings or in your browser settings, depending on the technology used by the specific service.

22. Push Notifications and Communications

The application may send service, security, operational or marketing notifications.

Service and security notifications form part of the provision of the application or service. We will send you marketing notifications only where we have a legal basis to do so. You may opt out of marketing communications at any time via the unsubscribe link in the communication, the application settings or the contact details set out in this policy.

You may also control push notification settings in your device's operating system.

23. Automated Decision-Making

The EMA application does not carry out decision-making based solely on automated processing that would produce legal effects for you or similarly significantly affect you.

If we were to introduce such processing in the future, we would notify you in advance and ensure that you have the rights to which you are entitled in that regard.

24. Your Rights

In connection with the processing of personal data, you have in particular the following rights:

  • the right of access to your data and information about its processing,
  • the right to rectification of inaccurate or incomplete data,
  • the right to erasure of data, where the statutory conditions are met,
  • the right to restriction of processing,
  • the right to data portability, where processing is based on a contract or consent and is carried out by automated means,
  • the right to object to processing based on legitimate interests,
  • the right to opt out of direct marketing at any time,
  • the right to withdraw consent, where processing is based on consent,
  • the right to lodge a complaint with the Office for Personal Data Protection.

25. Data Security

We use technical and organisational measures appropriate to the nature of the data and the risks of processing to protect personal data. These include in particular access controls, secure communications, logging, backups, security audits and contractual obligations imposed on persons who handle the data.

However, no electronic processing can be regarded as absolutely secure. It is therefore important that you also protect your device, email account, phone number and access credentials.

26. Children

The EMA application is not intended for children under the age of 15. If you are under 15, please use the application only with the consent and supervision of a legal guardian. If we discover that we are processing a child's data without an appropriate legal basis, we will take reasonable steps to delete or restrict it.

27. Changes to the Data Protection Policy

We may update this policy, in particular if the application, the purposes of processing, applicable law, the technologies used or our suppliers change. The current version will be available within the application. We will notify you of any material changes in an appropriate manner.

Model Withdrawal Notice

Complete and submit this form only if you are a consumer and wish to withdraw from a contract concluded at a distance.
